Will I Be Eligible For More Benefits When My Ex-Husband Files For His Benefits?
I received SS benefits at 62 about 8 years ago after 30 years of marriage. My income was very limited and during our marriage
My ex will file this year at 70 years of age. Will I be eligible to receive more benefits since he is filing at full retirement age?
Hi,
Your ex filing for his benefits likely won't have any effect on your benefit rate. If you filed for your retirement benefits at age 62, you would have been deemed to have also filed for divorced spousal benefits. So, if your ex was at least age 62 when you filed, and if your divorce had been final for at least 2 years at that time, you are likely either a) not eligible for divorced spousal benefits, or b) already receiving them.
It is possible, though, that you weren't eligible for divorced spousal benefits at the time you filed for your retirement benefits but are eligible now, so it wouldn't hurt to contact Social Security to see if you qualify.
