Is What Social Security Told Me True?
My husband and I have lived in two different states for the last two-plus years, and do not have a legal separation. We have been married now for 32 years. Social Security told me my social security would not increase if I divorced him because the amount I now receive is more than half what he receives. Is that true?
Hi,
Yes, it sounds like what they told you is correct. There is basically no difference in the benefit rates payable to spouses and divorced spouses. In either case, if you are already receiving benefits on your own record, and your own full retirement age benefit amount (PIA) exceeds one-half of your husband/ex-husband's PIA, you would not be eligible for a spousal/divorced spousal benefit.
