Should Spousal Benefits Be Suspended If The Worker's Benefits Are Suspended?

We had a client file for her regular benefits at 62 and her spouse file a restricted application at 66, his FRA. Since she has now increased her regular earned income her benefit is being deferred, but now SSI is also deferring his spousal benefit. Is this correct or should we advise them to move their case up the chain of command? We believe he should be entitled to his spousal benefit no matter what happens to her benefit.

That said, the Social Security earnings test applies to auxiliary benefits payable on the worker's record, including spousal benefits (https://secure.ssa.gov/apps10/poms.nsf/lnx/0300202035).
