How Will My Husband Be Able To Collect On My Social Security If He's From Costa Rica?

How will my husband be able to collect on my SS(if I die first!!) when he is from Costa rica
thanks in advance!!!

Hi,

Assuming that your husband would qualify to receive benefits on your record and he's living in Costa Rica, he could file a claim with Social Security's Federal Benefit Unit in Costa Rica. Address information can be found on Social Security's website: https://www.ssa.gov/foreign/foreign.htm.

However, if your husband is not a U.S. citizen and did not reside with you in the U.S. for at least 5 years of your marriage, then he probably wouldn't be able to receive spousal or survivor benefits on your record while living in Costa Rica (https://www.ssa.gov/pubs/EN-05-10137.pdf). He could, though, potentially receive benefits on your record if he's legally admitted to the U.S. for permanent residence.

Best, Jerry
