Can I Get Additional Benefits On My Estranged Spouse's Record?
I have been married to a man for over 15 yrs.I have not seen him I the past 14 yrs.I never filed for divorce.I have been drawing my ss and disability benefits fo 10 yrs or so.I use my husband before him,his last name, not the present one.Can I draw more benefits from the quote present husband that I have not seen.
Hi,
Assuming you are still married, or that the marriage lasted at least 10 years before ending in divorce, you may be eligible for an excess spousal benefit. However, you must be at least age 62 to be eligible, and your husband must be drawing his Social Security, or if you're divorced, he must be at least age 62. And, you would only be eligible for an excess spousal benefit if one-half of your husband's full retirement age benefit amount (PIA) is higher than your own PIA.
Best, Jerry
